DARCY HAWKINS

1. ENTIRE AGREEMENT:  This agreement contains the entire understanding between Darcy Hawkins and the client. It supersedes all prior and simultaneous agreements between the parties.  The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.

2. ONLINE GALLERY:  After the session once photographs have been edited, Darcy will provide the client with an online gallery via email.  This gallery will contain all edited photographs from the event.  Online gallery will be available for viewing/sharing/downloading within 30 days of session date.

3.  PAYMENTS:  The client agrees that the balance is due in full at the time of session prior to session start time.  Invoice will be sent to client.  Client agrees to pay a $100 non-refundable deposit to hold date for session.  If session must be rescheduled, deposit goes toward session at later date.

4.  MODEL RELEASE:  The client hereby assigns and grants Darcy Hawkins the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising or any other purpose and in any other manner and medium; the client hereby releases Darcy Hawkins from all claims and liability relating to said photographs.  It is agreed that Darcy Hawkins may display and use the photos for advertising and promotions.

5.  Darcy Hawkins takes the utmost care with respect to exposure, transportation and processing of photographs.  However, in the unlikely event of the client's photographs being lost, stolen or destroyed for reasons within or beyond Darcy's control, the Latters liability to the return of all payments received for the session.  The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals

BY BOOKING A SESSION WITH DARCY HAWKINS, MEANS I (THE CLIENT) HAVE READ AND UNDERSTAND THIS AGREEMENT, INCLUDING THE TERMS AND CONDITIONS, AND AGREE TO BE BOUND BY THEM.
